Welcome to Thrive Kickboxing ("we," "us," or "our"). These Terms and Conditions ("Terms") govern your access to and use of our website at www.thrive-kickboxing.com (the "Website"), as well as your participation in our services, including kickboxing classes, Muay Thai training, strength and conditioning programs, youth programs (for ages 6+), adult programs (for ages 16+), boxing sessions, team events, and any other offerings provided at our facility located at 10510 Dransfeldt Rd, Ste 103, Parker, CO 80134 (collectively, the "Services"). By accessing the Website, scheduling a class, purchasing a punch card or drop-in session, or otherwise using our Services, you agree to be bound by these Terms. If you do not agree, please do not use the Website or Services.


1. Acceptance of Terms
Your use of the Website and Services constitutes your agreement to these Terms. We may update these Terms from time to time, and the updated version will be posted on the Website with the "Last Updated" date. Continued use after any changes indicates your acceptance of the revised Terms.


2. Description of Services
Thrive Kickboxing offers fitness and martial arts training in a supportive, community-focused environment. Our Services include:

  • Kickboxing and Muay Thai classes emphasizing technique, personal growth, and empowerment.

  • Strength and conditioning sessions.

  • Youth programs for ages 6 and older.

  • Adult programs for ages 16 and older.

  • Boxing training.

  • Team and company events.

  • Free trial sessions for new participants.

Classes are available on a pay-as-you-go basis, with options for drop-in sessions or punch cards. We do not require contracts, enrollment fees, or monthly memberships. Schedules and class descriptions are available on the Website or at our facility. All classes are held at our Parker, Colorado location and are led by certified instructors in an inclusive atmosphere suitable for beginners and experienced participants.


3. Eligibility and Registration
To participate in our Services, you must be at least 18 years old or have parental/guardian consent if under 18. Youth programs require participants to be at least 6 years old, and adult programs require participants to be at least 16 years old. You may need to provide personal information to schedule a free trial or book classes via the Website. By providing this information, you represent that it is accurate and complete.


4. Payments and Pricing
We offer flexible pricing with no contracts or hidden fees:

  • Drop-in classes: Pay per session.

  • Punch cards: Purchase a set number of classes with no expiration date.

Pricing details are available on the Website or at our facility. All payments are non-refundable unless otherwise specified. We accept major credit cards and other payment methods as indicated at the time of purchase. Taxes and fees may apply. We reserve the right to change pricing at any time, but changes will not affect pre-paid punch cards.


5. Cancellations, Refunds, and No-Shows

  • Class Cancellations: You may cancel a booked class up to 24 hours in advance without penalty. Late cancellations or no-shows may result in the forfeiture of the session from your punch card or drop-in payment.

  • Refunds: All sales are final. Refunds may be issued at our sole discretion for extenuating circumstances (e.g., medical issues with documentation). Punch cards have no expiration and are non-transferable.

  • Facility Cancellations: We reserve the right to cancel or reschedule classes due to instructor availability, weather, or other unforeseen events. In such cases, we will provide notice via the Website or email and credit affected sessions.

6. User Conduct and Safety
You agree to:

  • Follow all instructor guidance and facility rules.

  • Respect other participants and staff, fostering our inclusive community.

  • Not engage in disruptive, dangerous, or illegal behavior.

  • Disclose any medical conditions or injuries that may affect participation.

Participation in physical activities involves inherent risks, including injury. You assume all risks and release us from liability (see Section 9). Appropriate attire and equipment (e.g., gloves, wraps) are required; we may provide rentals or sales.


7. Intellectual Property
The Website and all content, including logos (such as our lotus flower symbol), class materials, and promotional content, are owned by Thrive Kickboxing or our licensors and protected by copyright, trademark, and other intellectual property laws. You may not copy, distribute, or use our content without prior written permission, except for personal, non-commercial use.


8. Website Use
The Website is provided for informational and scheduling purposes. You agree not to:

  • Use automated tools to scrape or copy content.

  • Introduce viruses or harmful code.

  • Interfere with the Website's functionality.

We may terminate your access for violations. Links to third-party sites are for convenience; we are not responsible for their content.


9. Disclaimers and Limitation of Liability
THE SERVICES AND WEBSITE ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THRIVE KICKBOXING, ITS OWNERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICES OR WEBSITE, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PRECEDING 12 MONTHS.
You agree to indemnify and hold us harmless from any claims arising from your use of the Services, violation of these Terms, or injury to yourself or others.
10. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Colorado, without regard to conflict of laws principles. Any disputes shall be resolved exclusively in the courts of Douglas County, Colorado. You agree to waive any right to a jury trial.


11. Privacy

12. Miscellaneous
If any provision of these Terms is unenforceable, the remaining provisions remain in effect. These Terms constitute the entire agreement between you and us. Failure to enforce any right does not waive it.
